Note 1: No driver or app-user geolocation data is stored within any backend database; the platform runs on real-time data only.
Note 2: Geolocation data is not used to track or record vehicle speeds.
Note 3: Drivers do not have to display a complete phone number behind their GPS icon.
Definitions:
Those who install and run the app entitled 'CabMap® Driver's app' in order to share their GPS location and/or contact number online via a GPS-icon on the live interactive map at CabMap.com
Any person who uses the live map at CabMap.com in order to locate or connect with a driver by phone.
Any person who uses the consumer app that is simply entitled 'CabMap' in order to share their location or to locate or connect with a driver by phone.
Its a brand name held by airA2B ltd; a registered company (number: 14532196) of limited liability organized under the laws of the United Kingdom.
Terms & Conditions for website users:
1. Users of the CabMap® website always remain responsible for their own personal safety.
Persons who use the CabMap® website to connect with a driver can do so in the knowledge that:
A reputable payment gateway is required for each driver to put their icon on the live map and that fraud will not be tolerated on the CabMap® platform.
Terms & conditions for Drivers using the CabMap® GPS-Sharing subscription app:
1. Overview
These terms & conditions cover use of the CabMap® website and smartphone application
Use of the website and/or app indicates that you have read, understood, and agree to respect these terms & conditions.
If you do not agree to these terms & conditions, you may exercise your freedom to use an alternative platform.
If we must contact any advertiser, we will do so via the email address used as the basis of the app subscription.
2. Privacy Notice
airA2B ltd will not share Driver account details with third parties unless airA2B Ltd is required to provide such information to a law enforcement agency as part of an investigation.

3. Charges and Payment
Drivers / Operators must provide an e-mail address and password to create a user account and to activate their app subscription.
App subscriptions are charged monthly via reputable payment gateways (Google Pay or Apple Pay).
The monthly app subscription charge may be modified occasionally, for example to track inflation.
Drivers / subscribers will be informed prior to any price changes and given the opportunity to terminate their subscription if they do not wish to continue advertising pas the end of that month.
The monthly subscription fee is inclusive of applicable taxes including VAT unless specifically stated otherwise
4. Cancellation / Termination
The CabMap® app and website includes a facility to delete the user account. This may not terminate the Apple or Google based subscription associated with that email address and so the subscriber should terminate the subscription within their own Google or Apple accounts to ensure that no further monthly charges occur. Note: For traceability and record keeping purposes, the account details may be retained on the CabMap® user account database for an undefined period.
There can be no pro-rata refund for the remaining period of a month after the cancellation.
The account username will be relinquished when an account is deleted.
Subscription payment transaction failures will cause the user account to be suspended and therefore make the app inoperable. The payment gateways will automatically make multiple attempts to complete the scheduled subscription payment transaction however the account will be terminated after a reasonable number of repeated attempts.
Reactivation of accounts may require manpower that is not ordinarily available within the headcount of airA2B ltd's organisation structure, so it is not guaranteed to be possible.
Subscribers will face difficulties when attempting to use an email address that is already associated with another user account, suspended or otherwise.
airA2B ltd may suspend or terminate any user account without notice in the event of alleged abuse, misuse, fraud, illegitimate operation, or contravention of these terms & conditions.
airA2B ltd reserves the right to report serious allegations to law enforcement authorities.
AirA2B ltd reserves the right to take legal action against abusers where damages to the CabMap® enterprise have occurred.
5. Subscriber liability and Indemnity
Subscribers are liable for any damage suffered by airA2B ltd as a result of their violation of these Terms or misuse of the subscription app or website
This includes reputational damage evidenced via social media platforms.
This includes any form of defamation aimed at airA2B ltd or custom attained via our website.
This incurs costs incurred for any remedial actions necessitated by the contravening actions of an advertiser.
6. Limitation of Liability
Any liability which cannot legally be limited or excluded or alters your rights as a consumer that cannot be excluded under applicable law.
AirA2B ltd is not liable for:
The transportations services provided by a driver to their own customer as an independent commercial operation.
Damages or losses arising from work attained via our advertising platform.
The accuracy of your information shown online on the CabMap® platform.
Any eventuality beyond our reasonable control
The limit of airA2B ltd’s liability shall not exceed £500 unless specifically agreed in writing.
AirA2B ltd. accepts no liability for losses or damages incurred by third parties connected via the CabMap® platform.
Drivers using the CabMap® app should acknowledge that law enforcement agencies are perfectly entitled to use the CabMap® platform to conduct random spot checks and should therefore understand that it would be unwise to use the CabMap® platform without valid legal documents to hand.
7. Abuse of the CabMap® platform:
Drivers who advertise via the CabMap® platform are responsible for their own operational legality, wherever in the world they are operating. AirA2B ltd. cannot be held liable for app users who choose to act illegally.
In circumstances where CabMap is being used by a Taxi Driver:
Taking London as an example of a well-regulated marketplace, drivers must comply with strict regulations to avoid falling foul of the law:

8. Phone service integrity:
Advertisers cannot hold airA2B ltd liable for unsolicited nuisance phone calls that may have resulted from advertising on the CabMap®
Drivers / Operators using the CabMap® service are advised to use a business phone number and not their personal mobile phone number.
9. Intellectual property:
Our company and trademark will be protected via appropriate legal means.
The CabMap® Brand Identity: ‘CabMap®’ is a registered trademark in the United Kingdom in the form of a ‘Word Mark’ and may be registered around the world in line with ‘The Madrid Protocol’ over an undefined timespan.
With the kindest intention, we discourage web-squatting of CabMap TLDs internationally and advise that domain name-blocking or web-squatting will be dealt with through legal channels as the trademark is expanded into respective territories.

The CabMap® System Architecture and digital infrastructure constitutes a unique ‘concrete, useful, and tangible result’. Therefore, our technologically advanced strategy supporting our live-map, including the subscription-based smartphone application, and associated back-end service interactions, including the searchable username database, shall not be emulated or copied by third parties without the risk of prosecution.
10. Advertiser Usernames:
Usernames can be between three and twenty alphanumeric characters in length and may also contain underscores, hyphens and extraordinary emojis etc.
Usernames are ordinarily expected to resemble the commercial identity of the vehicle operator although it is possible that a driver may choose an unrelated memorable username to accrue a loyal customer base in within their region of operation.
Usernames are not guaranteed to remain permanently associated to a user account, which is primarily based upon an email address however airA2B ltd. will endeavour to maintain a user’s account ‘Ownership’ of username if a subscription is maintained because we recognise their embedded value as loyalty is accrued in the long term.
airA2B ltd may amend an account username unilaterally if presented with a justifiable reason to do so, for example if a trademark holder presents evidence of an infringement.
Account usernames are not ordinarily transferable between accounts by any facility within the CabMap® internal business systems.
Usernames should not:
· Contain offensive or worrisome terms.
· Impersonate un-associated persons, businesses, institutions/organisations etc.
· Squat; Username squatting for profit is discouraged by 8.3 above.
· Anticompetitive username blocking is discouraged by 8.3 above.
· Infringe trademarks.
· Raise political issues.
· Cause emotional discomfort to others.
· Be misleading.
· Incur mind peril.
Users who attempt to transfer their “Ownership” of usernames for profit do so at their own risk.
11. Non-Transferability Stipulation
airA2B ltd does not permit app users to share their accounts.
Drivers must not allow third parties to use their app.
Drivers must keep their login details confidential.
Must inform us immediately if their account has been compromised or if they believe their account has been used by another person.
12. Dispute Resolution Process:
In the event of a dispute, we would ask you to raise a complaint using the contact form at: https://taxi.digital/contact-us . In the unlikely event that we cannot resolve the dispute, we will work with you to discuss a way forward to resolve the dispute, which may include mediation. Our right to refer the dispute to a court is expressly reserved.
13. Governing Law and Jurisdiction
These Terms shall be exclusively governed by and construed in accordance with the laws of England, UK.
